COVID-19 Beach Usage Requirements

Maine State Boating Association Inc, DBA Sebago Boating Club (“SBC”) is a non-profit private boating club that leases beach rights to designated space on Rich Memorial Beach (“Beach”) from the town of Standish, Maine, to allow members to enjoy the use of the Beach. This document amends the Sebago Boating Club Rules (“Rules”) and is incorporated to said Rules by reference by adding the requirements (“Requirements”) found herein.

COVID-19 ASSUMPTION OF THE RISK, WAIVER OF LAWSUIT/LIABILITY

Sebago Boating Club cannot prevent you, your child(ren), and/or your guests from becoming exposed to, contracting, or spreading COVID-19 while utilizing the SBC services or premises (“premises” includes but is not limited to the Beach and any Beach facilities). It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize SBC’s services and/or enter onto SBC’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.


ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize SBC’s services and enter SBC’s premises. These services are of such value to me and/or to my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize SBC’s services and premises in person, specifically but not limited to the Beach and Beach facilities. I also agree to educate any of my guests joining me at the Beach and/or participation in SBC activities of these risks and their assumption of those risks.


WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against SBC and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives, including but not limited to the Town of Standish and their employees/agents/officials in connection with exposure, infection, and/or spread of COVID-19 related to utilizing SBC’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.


COVID-19 PREVENTION REQUIREMENTS


The following requirements are in accordance with the CDC, State and town of Standish requirements. Beach usage requirements and/or access may change. Please continue to monitor the Sebago Boating Club website for the most up to date information.


Currently, the Beach is open for all general Beach activities such as walking/sitting and related water activities. However, if Members do not follow these Requirements Beach privileges may be suspended and/or the Beach may be closed for the season. Please help follow these additional
  
COVID-19 Requirements to ensure our club remains in good standing with town of Standish and state of Maine.


Member and Member Guest(s) (jointly referred to as “Participants”) must follow these COVID- 19 Requirements in addition to the other posted Membership Rules to have Beach/Beach facilities access:

  • Participants nor any of the members of your/their household have been diagnosed with COVID-19 within the past 30 days;

  • Participants meet the state of Maine quarantine rules then in effect (for both Maine residents and non-residents) which can be found at https://www.maine.gov/covid19/;

  • Stay home if Participant(s) are not feeling well and/or have a fever;

  • Engaging in “social distancing” (remaining at least 6 feet away from other Participants

  • who are not part of your party), this includes when anchoring vessels;

  • When social distance cannot be maintained, Participants are required to wear CDC recommended face coverings;

  • Frequent hand washing with soap and water;

  • Use of hand sanitizer when soap and water isn’t available;

  • Cover coughs and sneezes.


It is your responsibility to ensure that you maintain social distancing or wear a CDC recommended face covering. This may mean choosing not to anchor/use the Beach if it is already crowded or leaving early if others arrive and make it difficult for you to maintain social distancing.


The use of Standish town facilities at the designated town beach (including but not limited to the boardwalk or outhouses) is NOT permitted.


Signage will be posted at the Beach and Beach patrol have been asked to remind participants to comply with these Rules to ensure we maintain our good standing with local and state authorities. If members (or their guests) should choose to not adhere to these guidelines their membership may be revoked.
